Terms and Conditions of Participation for the TelePart bonus campaign DRAGON RUN

hereinafter also referred to as “Bonus Campaign”

I. General

Organiser

The organiser of the Bonus Campaign is TelePart Distribution GmbH, Zeller Str. 17, D-73271 Holzmaden, hereinafter “TelePart” or “the Organiser”.

Participation / eligibility

These Terms and Conditions of Participation apply to the Bonus Campaign. TelePart reserves the right to exclude participants from the Bonus Campaign in the event of a breach of these Terms and Conditions of Participation.
Only customers of TelePart are eligible to participate. There is no charge for participating in the Bonus Campaign.

Period of the campaign

The Bonus Campaign will take place from 1 November 2017 until 16 February 2018. It is only within this period that the criteria relevant for collecting bonus points can be satisfied.

Structure of the bonus campaign

The bonus campaign consists of two parts. Both bonuses in kind (section II.) and travel prizes (section III.) will be offered.


II. Bonuses in kind campaign

Bonus points / bonuses

The participant will receive bonuses in kind depending on the point score achieved in four categories. Details on the bonuses in kind can be found on the TelePart website (www.telepart.com) or in the bonus campaign promotional material. Unless expressly noted otherwise, each bonus in kind is a product with a basic configuration.

Bonus points earned in connection with customer orders are credited to the customer-specific points account on a continual basis. The participant may earn bonus points for the number of sales made within the period of the campaign of smartphones and tablets from selected Chinese manufacturers. Within the meaning of this bonus campaign the brands included are Xiaomi, Meizu, Huawei, Lenovo, Cubot, Elephone, Kenxinda, Blackview, Nubia and OnePlus. The following applies in particular:

  1. Category 2: Number of Meizu smartphones/tablets purchased within the period of the campaign
    For every Meizu smartphone or tablet purchased from TelePart one point will be credited to the points balance in this category. The criteria for this category are satisfied when the participant has purchased a minimum of 20 Meizu products (smartphones or tablets) from TelePart.
  2. Category 3: Turnover days with Chinese Brands within the period of the campaign
    For every day of the bonus campaign on which the participant purchases from TelePart smartphones or tablets from the manufacturers relevant to the bonus campaign one point will be credited to the points balance in this category. The criteria for this category are satisfied when the participant has earned a minimum of 20 points.
  3. Kategorie: Umsatztage mit Chinese Brands innerhalb des Aktionszeitraums
    Für jeden Tag innerhalb des Aktionszeitraum, in dem der Teilnehmer Smartphones oder Tablets der für die Prämienaktion relevanten Herstellers bei TelePart erwirbt, werden dem Punktekonto in dieser Kategorie jeweils ein Punkt gutgeschrieben. Die Kriterien für diese Kategorie sind erfüllt, sobald der Teilnehmer mindestens 20 Punkte erreicht hat.
  4. Category 4: Number of different Chinese Brands
    For every specific brand of smartphone or tablet relevant to the bonus campaign which the participant purchases from TelePart, one point will be credited on a one-off basis to the points balance in this category. The criteria for this category are satisfied when the participant has earned a minimum of six points.

The bonuses in kind are divided into three bonus classes:

Each participant may claim only one bonus in kind.


III. Travel prize campaign

As well as the bonuses in kind during the period of the campaign two travel prizes are offered:

Travel prize 1: 14-day trip to Hong Kong for two persons including a visit to the Xiaomi manufacturing works. The travel prize includes the cost of air travel and accommodation costs for two persons in a 4-star hotel.

Travel prize 2:14-day trip to Hong Kong for two persons including a visit to the Meizu manufacturing works. The travel prize includes the cost of air travel and accommodation costs for two persons in a 4-star hotel.

Travel prize 1 will be awarded to the participant in the bonus campaign with the highest turnover in Xiaomi products during the period of the campaign.

Travel prize 2 will be awarded to the participant in the bonus campaign with the highest turnover in Meizu products during the period of the campaign.


IV. Other provisions

Bonuses / collecting bonuses

After the bonus campaign ends, those eligible for bonuses will be sent a written or electronic notification to the address/contact data on file with TelePart. Depending on the number of points earned in the individual categories, the participant is entitled to choose a bonus in kind from the selection of bonus products listed on www.telepart.com and must notify TelePart of this choice in writing. If the participant eligible to receive a bonus does not give notice within four weeks of the sending of the notification, the claim to a bonus lapses.

Bonuses in kind may be substituted by TelePart in its discretion (Section 315 of the German Civil Code) by equivalent bonuses in kind or cash bonuses, if collecting the bonus in kind is impossible or is associated with unreasonable effort for procurement or provision. Bonuses in kind may deviate from the bonuses depicted in the images provided by TelePart, in particular with respect to model, colour, or configuration. The deviating product must be equivalent to the product depicted in the image provided by TelePart.

TelePart will ship the bonus products at its own cost within Europe, but the participant must bear any other expenses exceeding the cost of shipping, in particular customs duties and levies. Shipment is not made until payment of these costs has been ensured by the participant.

If a bonus in kind is shipped, TelePart assumes no liability for the deterioration or loss of the item. The participant bears the risk of deterioration and accidental loss. The participant has no claim to insured shipment.

The provisions above also apply to the travel bonus campaign.

Exclusion of conversion/liability

Any claim to cash payment or an exchange of the bonuses is excluded; this applies also to any assignment of bonuses or bonus points to third parties./p>

The liability of TelePart and its vicarious agents is limited to culpable intent and gross negligence.

Exclusion from participation

TelePart reserves the right to exclude participants from participation in the bonus campaign if they have breached these Terms and Conditions of Participation and/or attempted to improperly influence the course of the bonus campaign. If this should be ascertained after determination of the bonus or after it has been sent, TelePart will retrospectively invalidate the bonus and demand that it be returned. /p>

TelePart may exclude from this bonus campaign those participants who have been in arrears of payment since the start of the campaign period until the bonuses in kind have been determined or those with whom legal disputes are being conducted in court or out of court.

Final clauses

The applicable law is the law of the Federal Republic of Germany. /p>

If individual provisions of these Terms and Conditions of Participation are or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be substituted by an appropriate provision which comes closest to the purpose of the invalid provision.
